MARGARET SALTY — TERMS OF USE

These Terms of Use ("Terms") govern your access to and use of all products, services, and materials offered by Margaret Salty / Margaret Salty LLC ("I," "me," "Margaret," or "the Company"), including content available at margaretsalty.com and through any associated learning platforms, mobile applications, downloadable resources, and 1:1 coaching services.

By purchasing, accessing, or using any of these Materials, you ("you," "the user," or "the buyer") agree to be bound by these Terms.


1. Ownership of Materials
All content provided through Lactation Exam Mastery, the Exam Mastery Study Guides, the Exam Practice Platform, the Exam Prep Mobile App, the PASS Framework, the Lactation Consultant Toolkit, all written materials, video content, audio content, downloadable PDFs, practice questions, image questions, exam simulator content, cheat sheets, custom study plans, 1:1 session materials, and any other product or service offered through margaretsalty.com (collectively, "the Materials") are the exclusive property of Margaret Salty / Margaret Salty LLC.

The Materials are protected by United States and international copyright, trademark, and other intellectual property laws. All rights not expressly granted to you in these Terms are reserved.


2. License Granted to You
Your purchase of any product or bundle grants you a limited, personal, non-transferable, non-exclusive, single-user license to access and use the Materials solely for your own individual exam preparation, personal professional development, and clinical learning.

This license is for one individual user only. If multiple individuals wish to access the Materials, each individual must purchase their own separate license.

This license does not transfer ownership of the Materials to you in any form. You do not have the right to copy, reproduce, redistribute, modify, sell, sublicense, publicly display, or create derivative works from the Materials.


3. Prohibited Uses
You agree that you will NOT, under any circumstances:

Share your login credentials for the course platform, Exam Practice Platform, mobile app, or any other access-restricted system with any other person, whether or not for compensation.
Copy, reproduce, redistribute, transmit, publicly display, or perform the Materials (in whole or in part) by any means now known or hereafter invented.
Post screenshots, photographs, scans, or direct quotations of the Materials to social media (including but not limited to Instagram, Facebook, TikTok, X / Twitter, LinkedIn, Threads, YouTube, Pinterest, or any successor platform), online forums, study groups (including private Facebook groups, Discord servers, WhatsApp groups, Reddit, or any similar platform), Slack workspaces, or any other public or semi-public venue.
Resell, lease, rent, or otherwise commercially exploit the Materials in any form, whether through direct sale, subscription, course-on-course resale, or any other monetization scheme.
Create derivative works based on the Materials, including but not limited to study guides, practice questions, courses, coaching programs, books, or workbooks derived from or substantially similar to any of the Materials.
Use the Materials to train, fine-tune, evaluate, benchmark, or otherwise input into any artificial intelligence model, machine learning system, large language model, or automated content generation tool, including but not limited to ChatGPT, Claude, Gemini, Copilot, Llama, or any successor systems. This prohibition applies whether the use is commercial or non-commercial.
Record, transcribe, screen-capture, or distribute any portion of a 1:1 session, live event, group call, or recorded webinar without prior express written consent from Margaret Salty.
Reverse-engineer, decompile, or attempt to extract the underlying code, structure, or proprietary methodology of the Exam Practice Platform, the mobile app, or any other software-based component of the Materials.
Use the Materials in any manner that could reasonably be interpreted as infringing upon, diluting, or harming the intellectual property, brand, or commercial interests of Margaret Salty / Margaret Salty LLC.


4. 1:1 Sessions
The 1:1 session included in the Lactation Exam Mastery bundle (or purchased separately) is a personal coaching service provided by Margaret Salty. The session is reserved for the registered purchaser only and may not be transferred to, attended by, gifted to, or shared with another individual.

Sessions may be recorded by Margaret Salty for quality assurance, future reference, or program improvement purposes. You may request access to your own session recording for personal review, but redistribution of any session content — including your own — is prohibited.

Materials shared with you during a 1:1 session, including but not limited to custom study plans, personalized notes, and recommendations, are subject to all the same protections and prohibitions as other Materials.


5. Score Reports and Confidential Information
If you submit your IBLCE score report or any other personal or professional information for the purpose of receiving a custom study plan, VIP upgrade, or any other personalized service, that information will be treated as confidential and will not be shared with any third party without your explicit consent.

You retain ownership of your own score report and personal information.
The custom study plan, recommendations, or personalized materials Margaret Salty creates from your information are the property of Margaret Salty / Margaret Salty LLC and are licensed to you under the same terms as other Materials.
You may not share, post, or distribute any custom plan or personalized output, even if it was built from your own data.


6. Tracking and Watermarking
Some of the Materials may contain digital watermarks, unique buyer identifiers, or other tracking mechanisms that allow Margaret Salty / Margaret Salty LLC to identify the source of any unauthorized distribution. By accessing the Materials, you acknowledge that such tracking may exist and consent to its use for the purpose of detecting, investigating, and addressing copyright infringement and Terms violations.


7. Enforcement
If you violate these Terms, Margaret Salty / Margaret Salty LLC reserves the right to:

Immediately terminate your access to all Materials, with no refund of any fees paid.
Pursue legal remedies, including injunctive relief, statutory damages, actual damages, lost profits, and attorney's fees.
Issue takedown notices to platforms hosting infringing material, pursuant to the Digital Millennium Copyright Act (DMCA) and similar international law.
Report violations to relevant professional licensing bodies (including but not limited to the IBLCE), employers, or platforms where appropriate, particularly in cases of substantial commercial infringement.

Violations of these Terms may constitute infringement under the U.S. Copyright Act (17 U.S.C. § 101 et seq.) and may be subject to statutory damages of up to $150,000 per work infringed for willful infringement, plus attorney's fees, as provided by law.


8. Reporting Suspected Infringement
If you become aware of any unauthorized use, copying, distribution, or sharing of the Materials, please report it confidentially to:

Reports will be reviewed promptly and treated as confidential to the extent permitted by law.


9. No Refunds
Because the Materials provide immediate digital access upon purchase, all sales are final. No refunds will be issued except where required by applicable law. If you have concerns or questions about a product before purchase, please contact hello@margaretsalty.com prior to completing your order.


10. Modifications to These Terms
Margaret Salty / Margaret Salty LLC reserves the right to modify these Terms at any time. Material changes will be communicated via email to current customers or via a notice posted at margaretsalty.com. Your continued use of the Materials after any such modification constitutes your acceptance of the revised Terms. The "Effective date" and "Last updated" dates at the top of this document indicate when the Terms were most recently revised.


11. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of laws principles. Any dispute arising from or relating to these Terms or the use of the Materials shall be resolved exclusively in the state or federal courts located in DuPage County, Illinois, and you consent to the personal jurisdiction of such courts.


12. Severability
If any provision of these Terms is found by a court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remainder of these Terms remains in full force and effect.


13. Entire Agreement
These Terms, together with the Privacy Policy and any other policies expressly posted on margaretsalty.com, constitute the entire agreement between you and Margaret Salty / Margaret Salty LLC regarding the use of the Materials, and supersede any prior agreements.


14. Educational Purpose Only — Not Medical Advice
The Materials provided through Lactation Exam Mastery and all related Margaret Salty / Margaret Salty LLC products are educational resources designed exclusively for the professional development of lactation professionals, including aspiring and current International Board Certified Lactation Consultants (IBCLCs), Pathway 2 students, and other lactation educators or clinicians.

The Materials are not medical advice. They are not intended to be used as a substitute for medical advice, diagnosis, or treatment by a qualified healthcare provider for any individual patient or family.

By accessing the Materials, you acknowledge and agree that:

The Materials are educational and informational in nature only.
Nothing in the Materials creates a clinician-patient relationship between Margaret Salty / Margaret Salty LLC and you, your patients, or any other person.
You are solely responsible for the clinical decisions you make in your own practice. You agree not to rely on the Materials as the sole basis for any specific patient care decision without exercising your own professional judgment and consulting current evidence-based guidelines.
No guarantee is made regarding your performance on the IBCLC exam, your professional licensing outcomes, or the outcomes of any patient or family with whom you interact. Exam results and clinical outcomes depend on factors outside the Materials.
The Materials reflect Margaret Salty's professional opinion and educational interpretation of current evidence as of the date of publication. Lactation evidence and clinical guidelines update over time, and you are responsible for staying current with the most recent evidence-based recommendations.


15. Limitation of Liability
To the maximum extent permitted by law, Margaret Salty / Margaret Salty LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Materials, including but not limited to lost profits, lost income, exam outcomes, professional licensing decisions, employment outcomes, or any patient care outcomes.

Margaret Salty / Margaret Salty LLC's total cumulative liability to you for any claim arising from these Terms or the Materials shall not exceed the total amount you paid for the specific product or service giving rise to the claim in the twelve (12) months preceding the claim.


16. Indemnification
You agree to indemnify, defend, and hold harmless Margaret Salty / Margaret Salty LLC and its affiliates from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from or related to: (a) your use of the Materials; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property right; (d) any clinical or professional decision you make in your own practice, whether or not informed by the Materials; or (e) any harm or claim brought by a patient, family, employer, or third party arising from your professional conduct.

MARGARET SALTY — REFUND POLICY

Summary
All purchases are final. Digital products are non-refundable due to immediate access. The full policy below covers a few specific exceptions and the rules for 1:1 coaching sessions. If you have questions about a product before purchase, email hello@margaretsalty.com — I'd rather answer questions up front than process refunds after.


1. General Policy
All sales of digital products and services through Margaret Salty / Margaret Salty LLC are final and non-refundable, except as specifically described in this policy.

This applies to:

Lactation Exam Mastery (the course)
Exam Mastery Study Guides
Exam Practice Platform (any access term)
Private Practice Success Course
The Lactation Exam Mastery Bundle and any other bundles offered through margaretsalty.com
Custom study plans (the free VIP retake upgrade)
Any free upgrades or bonuses attached to a paid product

The policy is firm because the products deliver immediately. The moment you purchase, the materials are downloadable, the platforms are accessible, and the value has been transferred.

If you have any hesitation before purchase, please email hello@margaretsalty.com first. I read every email personally and will help you decide whether the product is right for you.


2. 1:1 Coaching Sessions
The 1:1 coaching session — whether purchased standalone or as part of the Lactation Exam Mastery bundle — has its own rules.

If you have not yet scheduled the session: You have 14 days from the date of purchase to request a refund or credit toward a future product. After 14 days, the session is non-refundable but may be transferred to a future use within 12 months of purchase.

If you have scheduled the session:

You may reschedule the session at no charge by giving at least 24 hours' notice through Calendly or by emailing hello@margaretsalty.com.
Cancellations made less than 24 hours before the scheduled session forfeit the session.
No-shows forfeit the session.

If your 1:1 was part of a bundle and 1:1 inventory was sold out at the time of purchase: You received a $97 credit toward a future 1:1 booking when slots reopen. This credit is valid for 12 months from the original purchase date and may not be redeemed for cash.

If life circumstances make completing the 1:1 impossible (e.g., serious illness, family emergency, exam cancellation): Email hello@margaretsalty.com. I review these case-by-case and will work with you to find a resolution — typically a credit toward a future product or service.


3. Bundle Purchases
The Lactation Exam Mastery bundle (and any bundle offered by Margaret Salty / Margaret Salty LLC) is non-refundable as a whole because immediate digital access is provided to all bundled products at the time of purchase.

You cannot refund individual components of a bundle. The bundle is sold as one product at one price.

The 1:1 component within the bundle is governed by Section 2 above.


4. The Free VIP Retake Upgrade
The free VIP upgrade — the custom 8-week study plan and priority email access for previous test-takers — is included as part of a Lactation Exam Mastery course or bundle purchase. The VIP upgrade is not separately refundable.

If you refund or terminate access to the parent purchase, the VIP upgrade and any custom plan documents are also revoked.


5. Exceptions Where I Will Issue a Refund
A few specific scenarios where I will issue a refund or exchange:

Duplicate purchase. If you accidentally purchase the same product twice within a 7-day window, email hello@margaretsalty.com with proof and I'll refund the duplicate within 5 business days.

Technical inability to access the materials. If a problem on my end (broken login, server issue, file corruption) prevents you from accessing the materials within 7 days of purchase, email hello@margaretsalty.com. I will work to resolve the problem or, if I cannot, issue a refund for the affected product.

Wrong product purchased. If you purchased the wrong product (e.g., the standalone Exam Practice Platform when you meant to buy the full bundle) and have not yet accessed the product, email hello@margaretsalty.com within 48 hours. I'll exchange or credit toward the intended product.


6. Chargebacks
If you dispute a charge with your bank or payment provider without first contacting Margaret Salty / Margaret Salty LLC, this constitutes a violation of the Terms of Use.

If you have an issue with a purchase, please reach out to me directly at hello@margaretsalty.com. I read every email personally and resolve almost every concern within 48 hours.

If a chargeback is initiated without prior communication, I reserve the right to:

Immediately terminate your access to all materials.
Dispute the chargeback with documentation of these Terms and your purchase.
Pursue collection of any costs and fees incurred.


7. How to Request a Refund or Raise a Concern

Your full name
The email address used at purchase
The product or order number in question
A brief description of the issue

I respond personally within 48 hours during business days. I'd rather work with you directly than have you sit with an unresolved problem.


8. Modifications
I may modify this Refund Policy at any time. Changes apply only to purchases made after the modification date. The "Effective date" at the top of this document indicates when this policy was most recently updated.
